These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
SECTION 7 - NON-FULFILLMENT:
Smokestack Studios reserves the right to cancel and refund any orders at our discretion if we are unable to complete your order. A customer may be notified via their provided e-mail address prior to cancellation.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

SECTION 13 - INDEMNIFICATION:
You agree to indemnify, defend and hold harmless Smokestack Studios and our parent, subsidiaries, affiliates, partners, members, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 14 - SEVERABILITY:
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 15 - TERMINATION:
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 16 - ENTIRE AGREEMENT:
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
SECTION 17 - SPECIAL OFFERS:
Occasionally we will offer special promotions to our customers that we refer to as "special offers" "sale" or "special offer". This can include a gift with purchase, free shipping, or other promotional activity associated with a product purchase. These offers may be for a limited time only.
SECTION 18 - SHIPPING POLICY:
We ship our products using standard ground shipping via FedEx or USPS, depending on the item being shipped. We currently only ship to the contiguous United States. We do not ship to P.O. Boxes; your transaction may be canceled if an alternate shipping address is not provided within 48 hours of attempted contact by Smokestack Studios. If you would like an order shipped anywhere else, please contact us directly. All shipping/production times are not guaranteed and may vary based upon volume, demand, and lead time. Products will be shipped as soon as possible once payment is received. All orders will be shipped to the address you provide on the invoice during checkout. Be sure to verify your address because:
We will ship to the delivery address listed in the order confirmation. This includes PayPal addresses.
Any packages returned due to wrong or incorrect addresses will be reshipped at the cost of the customer.
Smokestack Studios is not responsible for FedEx and USPS failures, nor are they a reflection on our level of dedication to our customers. Packages lost after confirmed delivery are the responsibility of the purchaser at that time, thus any disputes must be directed to the delivery company that was utilized.
SECTION 19 - RETURNS AND REFUNDS:
All sales are final. No returns or exchanges.
Products found to have a fault upon delivery are classed as “Damaged On Arrival” (DOA). Smokestack Studios must be notified of these faults via e-mail at contact@thesmokestackstudios.com within 3 days of delivery. Failure to provide notification will exclude the product(s) from being classified as DOA, and the return will not be accepted. Smokestack Studios may replace any DOA product with an identical product upon receiving the returned item, if requested. The cost of the product being replaced must fall below the maximum provided insurance. Smokestack Studios will consider each DOA return on an individual basis.
Any undamaged order returned by a courier service due to a customers inactivity, refusal, and/or failure to receive the package(s) will be canceled and refunded less any shipping and handling charges and a 30% restocking fee. If Smokestack Studios considers the order damaged, no refund will be given until a claim with the courier service has been fulfilled.
If any order is returned at the customers discretion and without our approval, the package(s) will be rejected and returned to sender. Any costs/fees incurred are the responsibility of the customer. No refund will be given.
If a package is considered lost in transit under the couriers terms, a refund may be issued once a claim has been completed. If the lost package was shipped via the United States Postal Service a claim can only be filed if the package remains undelivered for a minimum of 30 days, but within 60 days, from the date of mailing. Smokestack Studios will take no action until we are able to file a claim. In most circumstances, packages arrive at their destination within 30 days. If the lost package was shipped via FedEx a claim may be filed immediately.
Smokestack Studios reserves the right to consider any returns on an individual basis. In the event that a return is approved by Smokestack Studios, a full refund of the purchase price of the product may be credited less the initial shipping fee, if applicable.
SECTION 20 - DAMAGED ITEMS AND INSURANCE:
We may request, on an individual basis, verification of the damaged item or a return of the damaged product in order to replace it. In the event your product was damaged during shipping we will replace it with a new product upon receiving the returned item, if requested. The cost of the item being replaced must fall below the maximum provided insurance.
No restocking fee will be charged.
FedEx shipments are insured on products up to $100 dollars and USPS shipments are insured up to $50. Damaged orders that cost more than the provided insurance will not be covered by Smokestack Studios.
SECTION 21 - ERRORS, INACCURACIES AND OMISSIONS:
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

SECTION 5 - E-COMMERCE:
Our store is hosted by Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases, and the general Shopify application. They store your data on a secure server behind a firewall.
Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
